End User License Agreement

Software programs sold by Datarecovery.com, Inc.
Last updated: October 15, 2026

IMPORTANT: READ CAREFULLY. This End User License Agreement (“Agreement”) is a legal agreement between you (“You” or “User”), either an individual or a single entity, and Datarecovery.com, Inc. (“Company,” “we,” “us,” or “our”) for the software program You purchased or downloaded from datarecovery.com, including APFS and HFS+ for Windows, barydata for Windows, SOL Seed Finder, vextract, and any other program the Company distributes under this Agreement, together with any associated media, documentation, license key, and updates (the “Software”).

BY PURCHASING, DOWNLOADING, INSTALLING, COPYING, OR OTHERWISE USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT PURCHASE, DOWNLOAD, INSTALL, OR USE THE SOFTWARE.

1. License Grant

Subject to the terms of this Agreement and payment of the applicable license fee, the Company grants You a non-exclusive, non-transferable, revocable license to install and use the Software on computers that You own or control, for Your internal business or personal purposes. The license key and order number issued at purchase identify Your license. This license does not grant You any ownership rights in the Software.

2. Restrictions

You may not: (a) sell, rent, lease, sublicense, distribute, publish, or otherwise transfer the Software, Your license key, or Your download link to any third party; (b) reverse engineer, decompile, or disassemble the Software except to the extent permitted by applicable law; (c) modify, adapt, or create derivative works based on the Software; (d) remove, alter, or obscure any proprietary notices or digital signatures on the Software; (e) use the Software to provide services to third parties on a service-bureau basis without the Company’s written consent; or (f) use the Software for any unlawful purpose or on data You are not authorized to access.

3. Ownership

The Software is licensed, not sold. The Company and its licensors retain all right, title, and interest in and to the Software, including all intellectual property rights therein.

4. Purchase, Delivery, and Refunds

  • The license fee is the price shown at checkout, plus any sales tax the Company is required to collect for the billing address You provide. Payment may be made by debit or credit card or in cryptocurrency as offered at checkout. A cryptocurrency price is quoted at a locked exchange rate for a limited time, and a cryptocurrency payment is final once the network confirms it.
  • The Software is delivered electronically. After payment, the download is available on Your order page, and a receipt with the same download link and Your license key is sent to the email address You provide. You are responsible for keeping that email and Your license key.
  • Because the Software is delivered electronically and cannot be returned, license fees are non-refundable except where a refund is required by applicable law or is granted by the Company at its sole discretion. Please read the program description and system requirements before buying.
  • Each program is digitally signed by Datarecovery.com, Inc. Do not run a copy whose digital signature is missing or invalid.

5. Nature of the Software; User Responsibility

The Software reads, mounts, copies, extracts, converts, or reconstructs data from storage devices, disk images, backup files, filesystems, networks, or wallet recovery phrases, as described on the program’s page. You acknowledge and agree that:

  • You are solely responsible for selecting the source data, destination locations, and program options, for verifying that each operation completed as intended, and for reviewing any reports or logs the Software produces.
  • You must maintain independent, separate backups of any data important to You. The Software is not a substitute for a backup strategy.
  • You should test the Software on non-critical data before relying on it for important data.
  • You are responsible for ensuring You have the legal right and authority to access, copy, and process any data, device, backup, or wallet on which You use the Software.
  • The Software may skip, fail to read, or be unable to fully process certain data, including damaged, encrypted, locked, in-use, permission-restricted, or unsupported files, volumes, and backups, and it is Your responsibility to review the Software’s output to determine whether a given operation was complete.
  • Where the Software can write to a storage device, writing to a damaged or failing device may make data harder to recover. Stop and contact a data recovery professional if a device shows signs of physical failure.
  • A recovery phrase, private key, or other secret You enter into the Software stays on Your computer. You are responsible for the security of that computer and for clearing the Software’s fields and Your clipboard when You are done.

6. Support and Updates

The Company provides support for the Software by email, during its normal business hours, at no additional charge. Support is provided on a reasonable-efforts basis by the Company’s engineers, who also work on data recovery cases; the Company does not guarantee a response time or that any particular issue can be resolved. The Company has no obligation to provide updates, upgrades, bug fixes, or compatibility with future operating systems, devices, or file formats, although it may publish new builds at its discretion. Professional data recovery by the Company’s engineers is a separate service under the Company’s service terms and is not included with the Software.

7. Third-Party Components

The Software may include or rely on third-party components that are licensed under their own terms, which are identified on the program’s page or within the Software (for example, the Dokan file system driver used by APFS and HFS+ for Windows, licensed under the LGPL). Those terms govern Your use of those components to the extent they conflict with this Agreement.

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

THE COMPANY DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS, THAT IT WILL RECOVER, READ, OR TRANSFER ANY PARTICULAR DATA, THAT ITS OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SOFTWARE WILL PREVENT DATA LOSS, DATA CORRUPTION, OR INCOMPLETE DATA TRANSFER, AND THE COMPANY EXPRESSLY DISCLAIMS ANY WARRANTY REGARDING THE SAME.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY DAMAGES FOR LOSS OF DATA, LOSS OF CRYPTOCURRENCY OR OTHER DIGITAL ASSETS, LOSS OF PROFITS, LOSS OF BUSINESS, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE USE OF OR INABILITY TO USE THE SOFTWARE, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT OR THE SOFTWARE SHALL NOT EXCEED THE GREATER OF (A) THE LICENSE FEE YOU PAID FOR THE SOFTWARE, OR (B) FIVE U.S. DOLLARS ($5.00).

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with Your use of the Software, Your violation of this Agreement, or Your violation of any rights of a third party.

11. Term and Termination

This Agreement is effective until terminated. The license granted herein terminates automatically, without notice, if You fail to comply with any provision of this Agreement. Upon termination, You must cease all use of the Software and destroy all copies. Sections 3, 4, 8, 9, 10, and 12 survive termination.

12. General

Governing Law. This Agreement is governed by the laws of the State of Illinois, without regard to its conflict of laws principles.

Entire Agreement. This Agreement constitutes the entire agreement between You and the Company regarding the Software and supersedes all prior or contemporaneous understandings.

Severability. If any provision of this Agreement is held to be unenforceable, that provision will be reformed only to the extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.

No Waiver. The failure of the Company to enforce any right or provision of this Agreement will not constitute a waiver of that right or provision.

Export Compliance. You agree to comply with all applicable export and import laws and regulations in Your use of the Software.

Changes. The Company may update this Agreement for future purchases by posting a new version at datarecovery.com/eula/. The version in effect on the date of Your purchase governs that purchase.
